Who Is Eligible for an L-1 Visa?

The L-1 visa is utilized by international companies to internally transfer managerial, executive, or specialized employees to provide services in the U.S. similar to those served in the company abroad. The beneficiary should have worked for at least one consecutive year in the past three years at the company abroad.

He or she must have also been employed as:

A person in an executive position
A person with specialized knowledge

A person in a managerial role

The beneficiary of an L-1 visa comes to the U.S. to work at a related company to the company abroad (affiliate, subsidiary, etc.) in an executive, managerial, or specialty occupational role.

Expedited Intra-Company Transfer

The L-1 Blanket program is designed to allow large multinational companies to move executives, managers, and specialty occupation employees to the U.S. with a shorter waiting period for visa adjudication compared to regular L-1 visas.

To qualify for an L-1 Blanket petition, the company must have a minimum of three offices anywhere in the world, and at least one office that has been conducting business in the U.S. for a minimum of one year.

In addition, the company must also meet at least one of the following requirements:

Have no fewer than 1,000 employees that are based in the U.S.
Be able to demonstrate total annual sales of at least $25 million
Have filed a minimum of 10 successful L-1 petitions in the past 12 months

Visas for L-1 Beneficiary Families

The L-2 visa is for immediate family members of the L-1 beneficiary (spouse and children under 21 years old). This visa allows family members to stay in the U.S. during the L-1 beneficiary’s period of approved stay. In addition, those who carry an L-2 visa can obtain a U.S. work permit, study full-time in the U.S., and travel freely within and outside of the United States as they wish.
